APA Appeals

The issue in this appeal was whether the district court erred in dismissing, for lack of jurisdiction, plaintiff's APA challenge to USCIS' denial of her asylee relative petitions for her children. A favorable decision by the Second Circuit here could clarify common jurisdictional errors that district courts make in immigration-related APA cases.
